Household Client Agreement

Last Updated: 27 October 2026 (v1.18)

1. Parties, scope and acceptance

1.1 This Household Client Agreement ("Agreement") is between Ceylon Seva (Pvt) Ltd ("Ceylon Seva", "we") and you, a private individual or household using the Platform to engage a Worker for domestic or household services ("Household", "you"). It supplements the Platform Terms of Service, which you have also accepted.

1.2 It applies to your engagement, through the Platform, of an independent contractor ("Worker") to provide domestic or household services — such as cleaning, cooking, gardening, driving, childcare or care services.

1.3 You accept this Agreement when you complete registration as a Household, by an affirmative act recorded as an electronic signature — an auditable record linking your account identity, the version of this Agreement accepted, and the date and time. This electronic signature is valid, binding and admissible, and satisfies any requirement for a signature, under the Electronic Transactions Act, No. 19 of 2006 (as amended).

1.4 The English version of this Agreement governs. A translation is provided for convenience; if its meaning differs, the English version prevails. You may ask for help understanding the Agreement before signing.

2. Engaging Workers through the Platform

2.1 The Platform allows you to request and engage Workers who offer their services as independent contractors. You request services through the Platform; a Worker is free to accept or decline. When a Worker accepts, you and the Worker contract with one another, as principals, for the services.

2.2 Ceylon Seva provides the Platform and facilitates the connection and payment between you and the Worker. Ceylon Seva is not a party to the service contract between you and the Worker, is not the employer of the Worker, does not supply labour or staffing to you as principal, and does not act as your employment, payroll or administrative agent.

3. Independent-contractor status and no employment

3.1 Each Worker you engage through the Platform is an independent contractor. The Worker is not an employee of Ceylon Seva, and you and the Worker engage one another on an independent-contractor basis.

3.2 You engage the Worker on that basis and will treat the Worker accordingly. In particular, you will: agree the task, result and schedule required, but not direct the detailed manner in which the Worker performs the services as an employer would; not integrate the Worker into your household as a member of staff; not require the Worker to work exclusively for you; and not represent the Worker as your employee.

3.3 The Worker is free to accept or decline engagements, to provide services to other clients and platforms, and to determine how the services are performed.

3.4 You are responsible for ensuring that your own engagement and treatment of the Worker is consistent with independent-contractor status. Ceylon Seva does not provide employment-law or tax advice. If your own conduct causes the Worker to be treated in law as your employee, that is your responsibility and not Ceylon Seva's, and the consequences of that treatment lie with you.

4. Statutory contributions — EPF, ETF and gratuity

4.1 Because the Worker is an independent contractor and not your employee, you do not, through the Platform, assume the statutory employer obligations (such as EPF/ETF contributions, gratuity or termination entitlements) that would apply to an employee.

4.2 Ceylon Seva does not register any Worker for EPF or ETF, does not receive, hold or remit any statutory contribution on your behalf or the Worker's, and does not prepare or file statutory employment returns for you. Any earlier arrangement under which Ceylon Seva offered to act as your payroll or statutory-filing agent no longer applies.

4.3 For information: under Sri Lankan law, domestic workers in direct household employment are excluded from mandatory EPF/ETF coverage, and a private household acting in its individual capacity is not able to register to make such contributions. Ceylon Seva therefore does not, and cannot, offer EPF/ETF enrolment for domestic Workers, and makes no representation that engagement through the Platform confers any statutory social-security benefit on a Worker.

4.4 A Worker who wishes to build statutory savings may be able to apply, in their own name, for voluntary self-employed membership of the Employees' Trust Fund under section 18 of the Employees' Trust Fund Act. Any such application is made by the Worker directly; acceptance is a matter for the ETF Board, is outside Ceylon Seva's control, and Ceylon Seva gives no assurance that it will be granted.

5. Fees, payment and taxes

5.1 You pay the Worker's agreed service fee, Ceylon Seva's service commission and disbursement fee, and any applicable tax through the Platform. Ceylon Seva collects the Worker's fee as collecting agent and passes the amount collected for the Worker to that Worker, without deducting its own fees from the Worker's agreed rate.

5.2 The fees, charges, calculation bases and reservation margin are published in the Fee Structure at https://ceylonseva.work/fees. This Agreement does not restate the rates. The Fee Structure and Terms clauses 6 and 7 govern when the amounts arise and how the card is charged.

5.3 When the roster is complete, or you elect to proceed with a partial roster, you confirm the displayed matching-fee charge to secure the booking. It comprises commission on the scheduled initial commission-covered period and the disbursement fee on that commission. It is not refunded if you later cancel. The initial commission-covered period lasts up to fourteen days from the engagement's start, ending earlier if the engagement ends. Those covered dates are fixed when the booking is secured and do not restart or enlarge if its dates later change. A declined or abandoned charge does not secure the booking.

5.4 Automatic charging for ongoing work requires your separate authorisation. Weekly card reservations cover scheduled charges and the published margin; they are not settled payments. After the weekly cut-off, the amount due is collected and unused reservation released. Commission already paid for the initial commission-covered period is not charged again. Amounts above the reservation are separately payable through Finances. Weekly statements cover Monday to Sunday for the engagement, identify the dates worked, and record the amount already collected. They are not a second bill.

5.5 Review recorded hours promptly. The billing week runs Monday to Sunday, with a cut-off at Monday 02:00 Sri Lanka time. Eligible days neither confirmed nor disputed at that cut-off are accepted at scheduled hours. Confirmed days use confirmed hours. Confirming a day's hours is your acceptance that the work was performed that day and is correctly charged, and a day settled at the cut-off without a dispute is accepted on the same basis; this concerns what the Platform charges and pays, not your rights against the Worker (Terms clause 7.15). A day you dispute before the cut-off is settled at the hours resolved or determined before the cut-off; if the dispute is still open at the cut-off it closes then and that day is settled at its scheduled hours — the hours you booked. Raise any disagreement before the cut-off, because hours are settled within their week: once a week has been settled, its days are not reopened, corrected or adjusted. Late questions must be raised with the support team, which can explain the outcome and address the engagement going forward. Terms clauses 7.14 and 7.15 govern determinations of disputed hours and their limits.

The final week of an engagement is an exception — the week containing the last day a Worker is scheduled to work. A dispute on a day in that week is never closed automatically, whatever its age, and the week is settled only once Ceylon Seva has decided every open dispute on it. Your final statement therefore rests on hours a person has decided, and follows that decision rather than the ordinary weekly cut-off. While such a dispute remains open you cannot extend the engagement's end date; the dispute must be decided first.

5.6 The roster and matching-fee payment must be complete at least seventy-two hours before the first working day. You must authorise automatic charging in time for the first weekly reservation. If the booking cannot meet these requirements, it is cancelled under Terms clauses 7.7 and 7.8.

5.7 Before work begins, cancellation after the matching fee is paid retains that charge, releases weekly reservations in full and allocates half of the retained matching-fee charge among confirmed Workers. There is no separate twenty-four-hour cancellation threshold. After work has begun, completed weeks remain payable and the current week is payable at scheduled hours; the engagement ends at that week's end and no later week is charged. Worker payment remains subject to collection.

5.8 A failed weekly authorisation or terminal collection failure may pause the booking; affected Workers do not accrue scheduled earnings for the suspended period and are free to accept other engagements during it. Eligible collection attempts are retried approximately daily. If an operator closes an unpaid pause, the account is blocked and the separately payable claim specified in the Fee Structure applies. An unworked refused week earns no Worker payment. Any discretionary payment to Workers in that situation is handled offline, case by case, and is not an automatic entitlement. A payment without a definite provider outcome is investigated rather than assumed to have failed.

5.9 Ceylon Seva does not guarantee your payment or fund your uncollected debt to a Worker. You remain responsible for amounts properly due. Additional Worker earnings may be held pending collection under Terms clauses 6.4 and 7.6. Chargebacks are governed by Terms clause 7.12; a charge for work you accepted remains owed even if it is reversed through your card issuer.

5.10 You remain responsible for your own taxes arising from your use of the Platform and engagement of Workers. Any Worker reward funded by Ceylon Seva is ex gratia, at its discretion, and is not an additional fee payable by you or a guaranteed benefit.

6. Your obligations

6.1 You will engage Workers only for lawful purposes and in accordance with applicable law.

6.2 You will provide a safe environment for any Worker performing services at premises under your control, and will not subject any Worker to unlawful, discriminatory, harassing, unsafe or degrading treatment. You will not require a Worker to work excessive hours, and will allow appropriate rest.

6.3 You will provide accurate information about each engagement, agree the scope and fee in advance, pay promptly through the Platform, and rate Workers fairly and in good faith.

6.4 You will keep confidential, and use only for the engagement, any personal data of a Worker you receive, in accordance with applicable data-protection law, including the Personal Data Protection Act, No. 9 of 2022 (as amended), and our Privacy Policy.

7. Worker rewards (ex gratia)

7.1 Ceylon Seva may, at its sole discretion, operate reward and recognition programmes for Workers, funded from Ceylon Seva's own revenue and paid by Ceylon Seva directly to the Worker (see Platform Terms of Service, clause 8). Any such reward is an ex gratia payment, made voluntarily and as a matter of goodwill; it is not wages, not a statutory benefit, and creates no contractual entitlement for any Worker and no obligation or additional charge for you. It does not affect the Worker's status as an independent contractor.

8. Use of the Platform; circumvention

8.1 The Platform is provided for engaging and paying Workers through the Platform. You will not use it in bad faith — including using it primarily as a directory to identify Workers in order to engage them off-Platform, or taking off-Platform a Worker first introduced to you through the Platform — for the purpose of avoiding Ceylon Seva's fees.

8.2 Such conduct is a misuse of the Platform and a material breach of this Agreement, and is grounds for Ceylon Seva to suspend or terminate your access, in addition to any other remedy available to it.

9. Vetting, insurance and no guarantee

9.1 Ceylon Seva may vet Workers and operate a ratings system to support trust on the Platform, but does not guarantee any Worker's identity, conduct, quality, suitability or performance, and a rating or vetting is not an endorsement. You are responsible for your own checks where an engagement requires particular care — in particular for childcare, care of vulnerable persons, driving, or any engagement giving access to your home.

9.2 Ceylon Seva does not insure Workers, you or the work carried out through the Platform. You should consider whether your household insurance is appropriate to the engagement.

10. Liability and indemnity

10.1 The Platform is provided "as is" and "as available", without warranties to the maximum extent permitted by law.

10.2 Ceylon Seva is not liable for the acts or omissions of any Worker, including any breach, negligence, misconduct, loss or damage. Your recourse in respect of an engagement is against the Worker.

10.3 You will indemnify and hold Ceylon Seva and its group harmless from claims, losses and expenses arising from your engagement or treatment of a Worker, your breach of this Agreement, or your breach of applicable law or another's rights — including any employment-related claim brought by a Worker arising from the way you engaged, directed, treated or ended the engagement of that Worker.

10.4 To the maximum extent permitted by law, Ceylon Seva is not liable for indirect, incidental, special or consequential damages. Ceylon Seva's aggregate liability to you for all claims arising out of or in connection with this Agreement is limited to one hundred thousand Sri Lankan Rupees (LKR 100,000). Nothing in this clause limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Data protection

11.1 Ceylon Seva processes personal data in accordance with its Privacy Policy and applicable data-protection law, including the Personal Data Protection Act, No. 9 of 2022 (as amended), as and when its provisions come into operation. You must handle any Worker's personal data you receive lawfully, keep it secure, and use it only for the engagement.

12. Intellectual property and confidentiality

12.1 Ceylon Seva and its group own all intellectual property in the Platform; you receive only a limited, non-exclusive, non-transferable, revocable licence to use it. Each party will protect the other's confidential information.

13. Suspension and termination

13.1 You may stop using the Platform and request account closure. Active engagements must first be ended under Terms clause 7.7; stopping use does not erase payment obligations. Ceylon Seva may suspend or terminate access for breach, circumvention, unpaid amounts or to protect users. The independent-contractor allocation, accrued payment obligations, liability, indemnity, confidentiality, intellectual property and dispute provisions survive termination.

14. Governing law and general

14.1 This Agreement is governed by the laws of Sri Lanka, and the courts of Colombo have exclusive jurisdiction. If any provision is invalid, the remainder continues. This Agreement, with the Platform Terms of Service and Privacy Policy, is the entire agreement between you and Ceylon Seva regarding your engagement of Workers through the Platform.
